TERMS OF PURCHASE
Client = Purchasers
Designer = Brand It Beautifully™
All purchases are final and non-refundable. No refunds, credits, or rollovers will be allowed for unused, forfeited, expired, or canceled services.
Client has spent a satisfactory amount of time reviewing Designer's work and has a reasonable expectation that Designer will perform the Services in a similar manner and style unless otherwise specified.
Although Designer will use reasonable efforts to incorporate Client’s suggestions and desires when providing Client with the Services, Designer will use its artistic judgment when providing Services for Client, which may not include strict adherence to Client’s suggestions.
After the first draft of the design has been provided, you'll have three (3) business days to review, approve and/or request revisions to ensure the project stays on timeline.
Upon payment of all our outstanding invoices for the project, and in exchange for such payment, we assign to you all rights.
In exchange, you grant us a royalty-free and permanent license to use representations of the designs and taglines in our portfolio (in all types of media), as a sample of our past works, in trade publications, educational material, to promote ourselves, and for competitions.
We may purchase or license from third party vendors materials used in your project (including source code, work-up files, software programs, photographs, illustrations, fonts etc.). Where we license such material, the intellectual property rights in the licensed material are governed by the licenses of the third-party vendors.
We will use our best efforts to prevent errors and omissions from occurring in web page information. If such errors or omissions occur, please notify us, and we will correct them for free, and that will be the limit of our responsibility and liability.
We will not be responsible for or liable to you for damages or loss caused by: your use of the designs and deliverables in ways that are not covered by the licenses we grant to you; anything done by us on your instructions or using material you provided to us; any breach of these terms and conditions by you; any legal, governmental, contractual, or other approvals that were required but which you did not obtain, and you will keep us indemnified for all damages, costs, fees, expenses, and legal fees on an indemnity basis that we incur due to any of these specific actions and omissions.
If any portion of these terms is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.
